The trademarks, service marks, and logos of ORAITHA.AI and/or NSIGNIS LTD (“Company’s Trademarks”) used and displayed on the our software and related services are registered and unregistered trademarks or service marks of ORAITHA.AI and/or NSIGNIS LTD. Other company, product, and service names located on the Software may be trademarks or service marks owned by others (the “Third-Party Trademarks,” and, collectively with Company’s Trademarks, the “Trademarks”). Nothing on our software and related services should be construed as granting, by implication, or otherwise, any license or right to use the Trademarks, without our prior written permission specific for each such use. Use of the Trademarks as part of a link to or from any site is prohibited unless establishment of such a link is approved in advance by us in writing. All goodwill generated from the use of ORAITHA's and/or NSIGNIS’s Trademarks serve to our benefit.
No rights in or to our software and related services or any part thereof, are granted and no use is permitted except as permitted under this agreement. No other use is permitted without prior written consent from ORAITHA.AI and/or NSIGNIS LTD. You may not sell, transfer, assign, license, sublicense, or modify the software and related services or reproduce, display, publicly perform, make a derivative version of, distribute, or otherwise use the Software in any way for any public or commercial purpose. The use or posting of the Software on any other website or in a networked computer environment for any purpose is expressly prohibited. Any violation of this Agreement, terminates access to the software and services related follwed by your immediate destraction of any copies you have made of the software.
In no event shall ORAITHA.AI and/or NSIGNIS LTD or any of its affiliates, or any of their respective directors, officers, employees, personnel or agents be liable or responsible for any claim, losses or damage, whether direct, special, indirect or consequential, resulting from the use of, or the inability to make use of, this website or its content, including, without limitation, damages for lost revenue, lost or damaged data, costs or other commercial or economic loss, whether based in contract, or any other theory of liability.
Unless you explicitly opt-in to our model improvement program, we will not use your User Content or Outputs to train or improve our AI models. Enterprise customers receive automatic exclusion from training data usage. For all other users, training data opt-out settings are available in account preferences.
Subject to the limitations described below, you own the Output you generate through the Services, to the extent permitted by applicable law. We assign to you all our rights, title, and interest in such Output.
We do not require attribution for Output you generate. However, you may be required by applicable law or professional standards to disclose that content was generated using AI systems. We recommend appropriate disclosure when using Output in regulated industries, academic contexts, or where material representation of authorship is required.
Our Services may include or integrate with third-party content, tools, or services. We do not claim ownership of third-party intellectual property. Your use of third-party content is subject to the applicable third-party licenses and terms. We are not responsible for any third-party intellectual property infringement claims arising from your use of integrated services.
We retain all rights to inventions, discoveries, and improvements developed in connection with the Services, including any patentable subject matter. If you believe you have developed a patentable invention using our Services, you remain responsible for filing any patent applications and complying with all patent laws. We make no representation regarding the patentability of any Output.
Our trademarks, logos, and service marks are our exclusive property. You may not use our trademarks without prior written permission, except as necessary to accurately describe your use of the Services. Any goodwill arising from use of our trademarks inures to our benefit.
We reserve the right to use anonymized, aggregated usage data for research and publication purposes. Such use will not include any personally identifiable information or proprietary User Content. If you use our Services for academic or research purposes, we encourage appropriate citation of our technology in publications.
THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE SPECIFICALLY DISCLAIM ALL WARRANTIES REGARDING NON-INFRINGEMENT, ACCURACY, ORIGINALITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT OUTPUT WILL BE FREE FROM THIRD-PARTY INTELLECTUAL PROPERTY CLAIMS.
ORAITHA.AI and/or NSIGNIS LTD may grant access to its API, to be used at your own risk and at your own sole responsibility. Such access (or attempt to access) to the API by the means described in the API documentation provided by us, if applicable, or in accordance to the developer credentials assigned by us. ORAITHA.AI and/or NSIGNIS LTD may set and enforce limits on the use of the API (e.g. number of requests, or the number of users you may serve), in our sole discretion. You hereby agree to, and will not attempt to circumvent such limitations documented with each API.
By using the API, you hereby absolutely, irrevocably and unconditionally, waive, release, remise and forever discharge ORAITHA.AI and/or NSIGNIS LTD, its directors, officers, employees, consultants, shareholders and their respective affiliates from any and all rights, demands, claims and liabilities whatsoever of any kind, known or unknown, which you or any other person on your behalf, may now or hereafter have or claim to have against the ORAITHA.AI and/or NSIGNIS LTD in connection with any resources provided under the API and/or the software and/or related services and/or under any external site and/or any other matter whatsoever, including without limitation, in connection with any potentially infringing resources disclosed through the API and/or the software and/or related services.
Without limiting the generality of the foregoing, clients and/or customers and/or design partners shall not, directly or indirectly: (a)Reproduce, duplicate, copy, trade, or resell the API or any content deriving from the API for any purpose, unless ORAITHA's and/or NSIGNIS’s express consent was obtained. (b)Sublicense an API for use by a third party. (c)Copy, translate, modify, create a derivative work of, sell, lease, lend, convey, distribute, publicly display, or sublicense to any third party. (d)Defame, abuse, harass, stalk, or threaten others, interfere with or disrupt the API or the servers or networks providing the APIs. (e)Scrape, build databases, or otherwise create permanent copies of the API, or keep cached copies longer than permitted. (f)Take an action with the intent of introducing to ORAITHA.AI and/or NSIGNIS LTD products and services any viruses, worms, defects, Trojan horses, malware, or any items of a destructive nature. (g)Misrepresent the source or ownership of the API, remove, obscure, or change any copyright, trademark, or other proprietary rights notices; or falsify or delete any author attributions, legal notices, or other labels of the origin or source of material.
